First Offense DWIThe penalties for a first DWI offense may depend on your blood alcohol reading (BAC) when you provided breath samples to the Alcotest. The legal limit in NJ is 0.08%. However, in New Jersey, if you are under the legal limit, you can still receive a DWI summons if you fail your road-side field sobriety tests administered by the officer. Therefore, it is absolutely necessary that you obtain a NJ DWI attorney experienced in handling these matters.

A conviction first NJ DWI offense with either no BAC reading, or a BAC reading above 0.08% but less than 0.10%, your New Jersey driver’s license will be suspended for three months; you will be fined between $250 to $400; you must complete 12 to 48 hours Intoxicated Driver Resource Center (IDRC) & satisfy the screening, evaluation & referral requirements to be completed on 2 consecutive days of at least 6 hours each. If these requirements are not met, then mandatory 2-day term of imprisonment & suspension of NJ driver’s license imposed until these requirements are met; insurance surcharges of $1,000 a year for three years; and 30 days incarceration in the court’s discretion.

A conviction a first NJ DWI offense with a BAC reading of .10% or higher, your New Jersey driver’s license will be suspended between 7 – 12 months; a fine of $300 – $500; 12 to 48 hours Intoxicated Driver Resource Center (IDRC) & satisfy the screening, evaluation & referral requirements to be completed on 2 consecutive days of at least 6 hours each. If these requirements are not met, then mandatory 2-day term of imprisonment & suspension of NJ driver’s license imposed until these requirements are met; insurance surcharges of $1,000 a year for three years; and 30 days incarceration in the court’s discretion.

And wait, there’s more… The judge may order the installation of an interlock device on your car for 6 – 12 months after the expiration of the period of suspension. If you don’t install the court ordered interlock device on your car, you may face an additional one-year driver’s license suspension.
