Federal Criminal Charges in NJ
Why You Need an Experienced Criminal Defense Attorney
If you or a family member is charged with a federal offense, you need to immediately contact a criminal defense attorney. This contact should be made before appearing in court as there may be many alternatives available before your case becomes part of the federal court system. Federal prosecutors will not charge you until they believe they have completed a thorough investigation. This investigation may include interviewing witnesses and issuing federal grand jury subpoenas for evidence. When the time is right, the government may send FBI agents to knock on your door. Before they charge you, the FBI agents may attempt to speak with you about the charges they are investigating. The FBI may try to convince you to speak to their agents about your case – the case they are investigating.
What should you do when the FBI knocks on your door?
When a federal investigation reaches the point when agents contact you, you have reached the point of no return. This is the point when you immediately need to contact a certified criminal defense attorney. This is the most important stage in your case for many important reasons. What should you do when federal agents come knocking:
- Immediately contact an attorney.
Before you speak to federal investigators, ask for their business card and call an attorney. Give the card to your attorney so he can speak with the agents and the Assistant U.S. Attorney first. Your attorney may find out if you are a witness, a subject, or a target. - Anything you say can be used against you.
If you agree to speak with federal agents without an attorney, any admissions you make can and will be used against you in your federal prosecution. - Anything you say that is FALSE can be used against you.
If you speak to federal agents, and say something that is false, misleading, or untrue, you can be charged with additional federal criminal charges. Do not try to lie, minimize or hide anything from federal investigators. - The agents already know the answers to the questions they are asking you. Federal investigators do not come to see you unless they have a good reason. Regardless of the reason, they have done an investigation and want your statement to reinforce their investigation. When the agents speak with you, they are testing you. They want to see if they can trust you and if you are telling the truth. Do not speak to federal agents without first speaking to a federal defense attorney.
